California Jury Awards $50 Million to Delivery Driver After Starbucks Hot Tea Causes Third-Degree Burns to Penis, Groin and Inner Thighs

A California jury awarded $50 million in damages to a delivery driver after determining that a Starbucks location was negligent in handling a scalding hot tea, resulting in severe burns and permanent disfigurement.


Michael Garcia filed a lawsuit against the coffee chain after an incident at a drive-thru where a cup of tea spilled into his lap, leading to third-degree burns. The jury found Starbucks liable, citing failure to ensure customer safety.


Garcia’s attorney stated that the accident had caused irreversible harm and emphasized the significance of the verdict in holding Starbucks accountable. While acknowledging Garcia’s injuries, Starbucks announced plans to appeal, arguing that the damages awarded were excessive and disputing the claim of negligence.


The incident occurred on February 8, 2020, at a Los Angeles Starbucks, where Garcia, working as a Postmates delivery driver, picked up three venti "medicine ball" teas. According to his attorneys, an improperly secured cup fell from a cardboard carrier, spilling the hot liquid into his lap. Video evidence presented in court captured the preparation of the drinks and the moment of the spill.


Garcia sustained severe burns to his groin, inner thighs, and penis, requiring two skin graft surgeries. His legal team argued that he continues to experience significant pain from any friction to the affected area. The case has raised concerns over beverage-handling practices and customer safety at Starbucks locations.
