Elisha Abbo Petitions Tinubu and the NJC to Stop the Elevation of Supreme Court Nominees Who Sacked him as Senator.
A petition has been sent to President Bola Tinubu to investigate the activities of Court of Appeal Judge, Justice Chioma Nwosu-Iheme, over alleged judicial misconduct in the ruling that removed Senator Ishiaku Abbo, who represented Adamawa North senatorial district in the 10th National Assembly. The petitioner urges the President to prevent her swearing in as a justice of the Supreme Court of Nigeria.
Speaking to journalists in Abuja on Wednesday, Senator Ishaku Abbo said he waited for the outcome of Supreme Court judgments on related cases before lodging his complaints. He described the ruling that removed him from office as "a miscarriage of justice" and lacking legal jurisprudence.
The former lawmaker pointed out that similar cases in the Governorship elections in Kano and Plateau State indicated errors by the Court of Appeal judge, even in the face of clear evidence in the ruling that removed him from office. He believes Justice Nwosu-Iheme and others in the Court of Appeal should be punished.
Abbo referred to a recent judgment in Kano, which ruled that the deduction of votes is illegal, exposing the injustice he faced. He claimed that Justice Nwosu-Iheme unjustly canceled elections in 253 polling units with 155,800 registered voters and deducted 57,775 valid votes.
Abbo recalled winning the February 2023 election with over 11,000 votes. He emphasized that 57,775 votes were canceled, and 253 polling units were nullified, meaning 27% of polling units in the senatorial district were affected.
He questioned the discrepancy between the treatment of medical professionals and drivers facing legal consequences for negligence, compared to the judiciary. Abbo called on President Tinubu and the National Judicial Council to swiftly investigate the matter and punish erring judges, serving as a deterrent to others.
Abbo also urged the NJC to investigate reported cases of compromised judgments, stating that the ruling did not align with the country's electoral jurisprudence. He insisted that the Nigeria Judicial Council (NJC) and the executive must prevent the swearing-in of Justice Chioma Iheme, and any other judge found wanting in the discharge of official functions.
